Terms and Conditions
1) Scope of application
1.1 All agreements with GYBE Trading GmbH (hereinafter referred to as the “seller”) are subject to the following general terms and conditions (hereinafter referred to as the “Terms and Conditions”), which are accepted by placing an order or accepting deliveries.
1.2 Side agreements or verbal agreements are expressly not accepted.
1.3 Deviations from these Terms and Conditions must be confirmed in writing by the seller to be valid.
1.4 By placing an order, the buyer accepts the terms and conditions of sale, delivery and business.
2) Conclusion of the contract
2.1 The product descriptions contained in the seller’s online shop do not constitute binding offers, but serve as an invitation for the customer to submit a binding offer.
2.2 The customer may submit an offer using the order form integrated into the online shop. By completing the ordering process, the customer submits a legally binding offer.
2.3 The seller may accept the offer within five days:
- by written order confirmation (email, fax),
- by delivery of the goods,
- or by a request for payment.
The contract is concluded when the first of these alternatives occurs.
2.4 If "PayPal Express" is selected, payment is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg.

2.5 The contract text is stored and sent to the customer by email.
2.6 Input errors can be corrected before submitting the order.
2.7 The contract language is German.
2.8 Communication generally takes place by email. The customer must provide a valid email address.
3) Copyright and rights of use
The buyer is responsible for compliance with copyright laws. No liability is accepted for templates.
4) Prices and payment terms
4.1 All prices are total prices including statutory VAT. Shipping costs are stated separately.
4.2 Available payment methods are displayed in the online shop.
4.3 For payment in advance, payment is due immediately.
4.4 PayPal payments are processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., Luxembourg.
4.5 "SOFORT" (Klarna) is processed via SOFORT GmbH, Munich.

5) Delivery and shipping terms
5.1 Delivery is made to the address provided.
5.2 If delivery problems are caused by the customer, the customer shall bear the costs.
5.3 Collection in person is not possible.
5.4 Delivery times are non-binding until the order confirmation.
6) Retention of title
The goods remain the property of the seller until payment has been made in full.
7) Warranty
7.1 Defects must be reported in writing.
7.2 Transport damage must be reported to the carrier immediately.
7.3 Alterations to the goods will void the warranty.
7.4 Complained-about goods must be returned.
7.5 Liability exists only in cases of intent or gross negligence.
7.6 Multiple subsequent repairs (more than three) are permitted.
8) Applicable law
The law of the Federal Republic of Germany shall apply.
9) Place of jurisdiction
The place of jurisdiction is the seller’s registered office, provided the customer is a businessperson or a legal entity.
